        <![CDATA[<p>It’s easy to find sources online ready to give advice about what to do when you get in a <a href="http://www.chicagotriallaw.com/Motor-Vehicle-Accidents/">car accident</a>. Many of them with numbered lists of things you should do and steps you should take. Although some of those lists may be helpful, I would be willing to bet that anyone would find it difficult to remember what 10 things they should do just after being in car accident. That’s why, with this blog post, I’d like to focus on what I feel is the most important thing to remember for accident victims: Seek medical treatment as soon as possible and follow up with your doctor. </p>

<p>People who have been in car accidents know that a person can easily become disoriented after being hit by another car. And, depending on how severe the collision was, an accident victim can be badly injured or even lose consciousness. That’s why it’s important to get medical care right away. </p>

<p>Also, you may not be aware of the full extent of your injuries immediately after the accident. Follow up with your doctor and pay close attention to your condition. Report any changes in symptoms to your doctor and keep a written record of your treatment whenever possible. The most important thing is your health. That should be the first priority for any accident victim. </p>

        <![CDATA[<p>A recent ruling by the <a href="http://www.state.il.us/court/">Illinois Supreme Court</a> determined that companies whose employees are exposed to <a href="http://www.chicagotriallaw.com/Product-Liability/">asbestos</a> on the job may owe a duty of care to protect the worker’s family members who are exposed to asbestos second-hand. The facts of the case involved the wife of a railroad company employee who was diagnosed with mesothelioma. She sued her husband’s employer, claiming that she became sick after being exposed to asbestos that was on her husband’s clothes. This ruling by the Court overturns the ruling in a previous case involving a wife who sued the company where her husband worked for 6 years, rejecting the argument that a direct relationship must exist, like that of a company and employee, in order for the company to have a duty of care. </p>

        <![CDATA[<p>Imagine this scenario. You were following the law in Illinois and bought car insurance. You had the misfortune of being involved in a <a href="http://www.chicagotriallaw.com/Motor-Vehicle-Accidents/">car accident in Illinois</a> and the other driver had no insurance. You still have options. Illinois law requires <a href="http://www.chicagotriallaw.com/Motor-Vehicle-Accidents/Uninsured-Underinsured-Motorists.shtml">uninsured motorist coverage</a>, or UM coverage. <a href="http://www.ilga.gov/legislation/ilcs/ilcs4.asp?DocName=062500050HCh.+7+Art.+II&ActID=1815&ChapAct=625%A0ILCS%A05%2F&ChapterID=49&ChapterName=VEHICLES&SectionID=59528&SeqStart=90500000&SeqEnd=92500000&ActName=">(625 ILCS 5/7-203)</a>. This means that even in cases where the at-fault driver had no insurance, the law is meant to place the policy holder in substantially the same position he or she would have been in if the wrongful driver carried minimum liability coverage. </p>

<p>In Illinois, the minimum liability coverage for an auto policy required as of the date of this blog-entry is $20,000 for one injured person per accident, up to $40,000 for two or more injured people per accident, and $15,000 for property damage. This type of coverage is often referred to as 20/40/15. This is also the minimum UM coverage required by law in Illinois. UM coverage will normally match the amount of liability coverage. So, if a policyholders liability coverage is over 20/40, his or her UM coverage will match the liability coverage, unless the policy holder rejects the additional coverage in writing. In addition, the "insurance company providing the coverage must provide applicants with a brief description of the coverage and advise them of their right to reject the coverage in excess of the limits." <a href="215 ILCS 5/143a-2">(215 ILCS 5/143a-2)</a>. In other words, where a car insurance policy holder has liability coverage over the minimum, his or her UM coverage will match those limits unless after being advised by the insurance company the policyholder rejects the additional coverage. </p>

<p>Another possibility is that the wrongful driver did have insurance at the time of the accident, but it wasn't enough. In that case you may have an <a href="http://www.chicagotriallaw.com/Motor-Vehicle-Accidents/Uninsured-Underinsured-Motorists.shtml">under-insured motorist claim</a> or a UIM claim. If an accident victim's claim is greater than the liability coverage of the at-fault driver, the injured person may be able to recover the difference between his or her claim and the wrongful driver's policy limits through a UIM claim. </p>

<p>These policies generally also apply to your spouse, family members living with you and passengers injured in a car covered by the policy. It can also apply to <a href="http://www.chicagotriallaw.com/Motor-Vehicle-Accidents/Car-Accidents/Car-Accidents-and-Hit-And-Run.shtml">hit and run</a> cases, and cases where a <a href="http://www.chicagotriallaw.com/Motor-Vehicle-Accidents/Pedestrian-Accidents.shtml">pedestrian</a> or <a href="http://www.chicagotriallaw.com/Motor-Vehicle-Accidents/Bicycle-Accidents.shtml">bike rider</a> is hit by an uninsured or under-insured driver. </p>

        <![CDATA[<p>Some people think that it's better, from a legal perspective, not to shovel snow from their sidewalk. This belief stems from the idea that not shoveling snow will somehow protect a property owner from getting slapped with a lawsuit. </p>

<p>This issue is directly addressed by the <a href="http://www.ilga.gov/legislation/ilcs/ilcs3.asp?ActID=2084&ChapterID=58">Illinois Snow and Ice Removal Act</a>. The Act is meant to protect property owners who clear ice and snow from their sidewalk. In general, so long as a resident makes an effort to remove snow and ice from their sidewalks, he or she won't be held liable for injuries resulting from a slip and fall on their sidewalk, except in cases of clear wrongdoing as defined by the Act.So what does this mean for slip and fall victims? </p>

        <![CDATA[<p><a href="http://www.countyofkane.org/Pages/default.aspx">Kane County</a> prosecutors have filed charges against Stephen P. Orland, a band teacher at West Aurora High. Orland, who had been teaching at the high school for 19 years, was suspended last May after charges were announced stemming from allegations of <a href="http://www.chicagotriallaw.com/PracticeAreas/SexualAbuseAssault.asp">sexual abuse</a>. </p>

<p>According to court documents filed by prosecutors, The teacher was confronted by the school’s superintendant after a janitor reported seeing him hugging a female student in the band room. The janitor also stated that the teacher ran away immediately after seeing the janitor. The documents filed also allege that following this incident the district superintendent warned Orland that he could be fired if found alone with a female student. </p>

<p>Kane County authorities also allege that Orland engaged in sexual acts with female students on school grounds. In Illinois, there are circumstances where employers, such as schools, may be held liable for <a href="http://www.chicagotriallaw.com/PracticeAreas/SexualAbuseAssault.asp">sexual abuse</a> committed by their employees. In those types of cases it is important to determine whether the employer knew or reasonable should have known of similar allegations of sexual abuse by its employee or of potential danger of such abuse, but continued to employ that person or allow him or her access to children.</p>

        <![CDATA[<p>A man died in a two vehicle crash involving a <a href="http://www.chicagotriallaw.com/PracticeAreas/DrunkDrivingAccidents.asp">drunk driver</a> around 3 a.m. Sunday morning on Chicago’s South Side. The man was pronounced dead about an hour later after being transported to <a href="http://www.nmh.org/nm/home">Northwestern Memorial Hospital</a>. According to the fire department, one of the cars involved in the incident collided with a pole. </p>

<p>Others were also injured, but the crash is still under investigation as authorities have not identified which driver involved was intoxicated. Paramedics transported the other passengers in critical condition to <a href="http://www.advocatehealth.com/cmc/default.cfm?id=1">Christ Medical Center</a> in Oak Lawn. Another person was taken to <a href="http://www.advocatehealth.com/trin/default.cfm?id=1">Advocate Trinity Hospital</a>. </p>

<p>The <a href="http://www.dot.state.il.us/trafficsafety/factsheet.html">Illinois Department of Transportation</a> reported that DUI related crashes are three times as likely to occur at night as during daylight hours.         <![CDATA[<p>New criminal charges have been announced in connection with the <a href="http://www.washingtonpost.com/sports/penn-st-officials-step-down-amid-sex-scandal/2011/11/07/gIQAgL0zuM_video.html">Penn State sex abuse scandal</a>. Two top administrators from the university, Athletic Director Tim Curley and senior vice president for business and finance, Gary Schultz, are facing perjury charges for failing to report suspected <a href="http://www.chicagotriallaw.com/PracticeAreas/SexualAbuseAssault.asp">child sex abuse</a> by Penn State’s former defense coordinator Jerry Sandusky. </p>

<p>Sandusky was arrested Saturday on charges of <a href="http://www.chicagotriallaw.com/PracticeAreas/SexualAbuseAssault.asp">sex abuse</a>. It is reported that the former football coach targeted boys he met through a charity he founded for at-risk youths called The Second Mile. The charity announced on Sunday that Sandusky ceased having any involvement with children through the charity since 2008 when he informed the organization that he was under investigation for sexually abusing young boys. </p>

        <![CDATA[<p>This year’s winter weather predictions for the Midwest are gloomy. That should make even the seasoned Midwesterner want pack up and move to a sunnier place. For the <a href="http://www.cityofchicago.org/city/en.html">City of Chicago</a>, this means snow shovel sales are sure to go through the roof. </p>

<p>Despite these predictions, some Chicago residents believe they are better off not shoveling their sidewalks because doing so will open them up to the possibility of getting sued if someone slips on the ice in front of their house. This begs the question; “Am I better <a href="http://www.chicagotriallaw.com/CM/PersonalInjuryandChildren/Premises-Liability-and-Children.asp">protected from liability</a> if I don’t shovel my show?” A review of Illinois law should convince even the most stubborn Chicagoan that this is not the case. </p>

This might not be the case for ice ruts caused by foot traffic.         <![CDATA[<p>A retired couple from Chicago were killed in a three-car accident in <a href="http://maps.google.com/maps?q=goodhue+county+minnesota&hl=en&hnear=Goodhue,+Minnesota&t=m&z=9&vpsrc=0">Goodhue County, Minnesota</a> over the weekend. The couple were hit by a car traveling southbound on U.S. 52 as they were crossing the road headed westbound on Goodhue County Road 9. Authorities had detected alcohol on two of the three drivers.</p>
